    Banks cannot prove beyond reasonable doubt that any Mortgage exist, that's what Clint Coons doesn't know!!! Yes he's correct the bank can call the loan due, but cannot prove evidence that a Mortgage infact exist!!!! Remember it must all be Proven on the record okay! Is it not a true Fact that the Bank as the moving party have the burden of proof???

    Wouldn't the owner of a WY LLC be revealed during depositions as part of "sue everyone involved" when it is the listed member of the LLC holding the rental property or can a WY LLC simply ignore discovery attempts without risking a default judgement?

    This assignment business sounds too good to be true. If the LLC was setup to own real estate, people would do this all day to avoid reassessment? Change in membership and/or proportion in case of more than one member does trigger reassessment

    I need to set up a structure in the next 30-60 days. Still saving money for it, but I'm wondering if the structure is only good until the end of the tax year or is it solid for an entire 12 months? If it takes me a few months to close a deal or few, I just want it to be worth the cost of setting up before the year ends. Hopefully that makes sense. Basically I don't want to fork out all this money & let's say I only close a deal or 2 by the end of the tax year. Should I just wait until January? I really don't want to wholesale under my name but I don't want to waste money either so I feel stuck. Thanks

    Let's say the management corp generates profit (not so many expenses). Instead of the management corp taking a 20% interest in the account holding entity, paying corporate tax, paying tax of qualified dividends, is there a way to make a structure that flows income as carried interest?

    So Person 1 was fronting the money for Person 2 to buy the house in Person 2's name? Person 1 was acting as Person 2's private money partner, and should have gotten the needed documents to show that, and that money should have been given to escrow and not directly to Person 2. Hindsight is twenty/twenty unfortunately.

    I would have the LLCs owned by a nonprofit in a charitable immunity state like VA or NJ. The other thing you did NOT discuss is that states like New York are working on their own version of the Corporate Transparency Act (CTA) that will be effective in December of this year. Nonprofits do NOT have to comply with the CTA nor do the nonprofits they control have to comply with the federal CTA law

      A nonprofit is required to set up a Board of Directors and it also requires a higher level of review from IRS.

      @@user-rk6vc8wy8p Nonprofits do NOT require boards of directors in MA, CA, DE, VA etc you just need one person as a director and that can be a nominee. The IRS only requires you to fill out form 1023ez to be exempt the form is only 2 and half pages long. I was a former attorney and lobbyists.

    Geez, what's this other guys issue lol. How does this work with a wholesale business structure? I want to close deals not in my real name but I also don't want to piss of sellers or cash buyers as I'm trying to build relationships & build a solid cash buyers list.     Another BS law passed by Democrats to put their noses in my business and their hands in my pocket. I just found out about this today and read the bill. I said to myself that there is no way this is constitutional. The fines! $500 a day!? they will take their time letting you know that you didn't file, like in 3 years. do the math on that fine.     I'm setting up two LLCs at present just so I can protect the trademark and intellectual property of one of them from any potential lawsuits against the other. It may seem like overkill to some, but the additional costs and administrative burden is worth it to protect your assets.
